I want to take this opportunity to explain KDE's efforts to implement HB 380.
Prior to my arrival, under the direction of Commissioner Gene Wilhoit, superintendents were notified of the requirements of HB 380 in regard to the school calendar. The notices date back to April 21, 2006. Since then, superintendents have received four additional notices on what this bill requires.
Obviously, HB 380 has created unintended consequences. However, it is not an issue of whether we agree with HB 380. KDE and I must enforce the laws of the Kentucky General Assembly.
A great deal of misinformation exists over this issue.
I have done everything I can to encourage the current General Assembly to change the law relative to this matter. However, as of today, March 25, I do not know if the law will be changed during this session.
If permitted, we would change HB 380. However, at this time it would be prudent for you to meet the requirements of HB 380 to prevent reductions in your district's SEEK funding. The language of HB 380 on instructional days is as follows:
Requires that the school term for fiscal year 2007-2008 include the equivalent of 177 instructional days and no less than two additional six-hour instructional days in addition to the six-hour instructional days included in the 2005-2006 school calendar as approved by the Department of Education. Districts shall not be required to exceed 177 six-hour instructional days. Provides $32.6M for this purpose in FY08.
